The accused, Hassan Benfrej was detained and subsequently charged to court for his failure to honor the above stated amount owed to Radisson Blu and has made his third appearance before Magistrate Binneh Kamara in respect of the allegation levied against him by the General Manager of Radisson Blu Mammy Yoko Hotel , Nuro Neves.
During the accused third appearance before Magistrate Binneh Kamara on Wednesday 23th March 2016, the Lead Defense Counsel, James Fornah Sesay had earlier applied for the matter to be discharged on the grounds that, since the matter commenced in court N0.1 the prosecution has not led a single evidence in the matter.
He argued that his Client is brought before the court on mere allegations which the court is yet to prove beyond doubt and instead of the prosecution fast track the appearance of witness or witnesses in court for evidence to be led, it is relying on prolonged adjournments and giving flimsy excuses against the courts interest and precious time.
Lawyer Fornah also applied for bail on behalf of his Client and went further to informed the court that, his Client is credible and reliable person who has much respect for the court and will always make himself available on every adjourned date.
He said there are respectable and credit worthy surety who is ready and willing to enter into any recognizance on his Client behalf and concluded by saying that justice must not only be done but must be seen to be done.
The police prosecutor, Assistant Superintendent of Police, ASP Samuel Kamara did not object to bail for the accused and assured the court that, the prosecution will go all out to get witness or witnesses to testify on the next adjourned date.
At this stage, Magistrate Abubakar Binneh Kamara granted bail to the accused, Hassine Benfrej in the sum of two hundred million leones including one surety who should produce his national passport book, a bank statement equivalent to two hundred million leones and bail to approve by the Master and Registrar of the court. The matter comes up again on Tuesday 29th March 2016.
It will be recalled that the accused, Befrej Hassine between 7th November 2015 and 25th February 2016 at the Radisson Blu Mammy Yoko Hotel at Aberdeen in west part of the country’s capital Freetown, incurred debt or liability to the General Manager of Radisson Blu Mammy Yoko Hotel, Nuro Neves and he obtained a credit amounting to over one hundred and eighty four million leones by means of fraud other than false pretences contrary to law.
